The Differences between Law and Politics

Law and politics go together hand in hand. It’s hard for a common man to distinguish between the two even though both are for the well-being of people. In this article, we will put little light on the differences between law and Politics

Law is a system usually enforced through a set of institutions in the form of rules and guidelines. It gives shape to the politics, society and economics in so many ways and also serves as a social mediator of relationship between people. The rules of law are better than the rule of any individual. Law is categorized in so many types to serve the various needs of our society like contract law, property law, trust law, tort law, criminal law, constitutional law, administrative law, international law. Police, Army, Advocates and judge etc. are those set of people who helps in maintaining the law in the society. Punishments are given to those people who break these laws or do any illegal activity. Anything which is against the law is illegal and which is not against is legal

Politics is the process of making collective decision by a group of people. You can observe politics in corporate, academic and other religious institutions interactions. The term politics consists of social relations involving authority or power and refers to the methods and tactics used to formulate and apply policies. A politician or political leader holds the decision making power in government. These people are selected by the common people by the means of elections. Some of people seek those positions by appointments, right of inheritance or by other means.

So, to understand the difference between law and politics, we can say that law is the legal form of guideline/ system whereas politics is the illegal way of using the personal relations or authority. Politics creates negative behavior amongst the section of the society or group of people.

In today’s world, politics seems to be leading the country whereas it should be law leading the country. Respect to law and adherence to law creates a positive and a healthy atmosphere amongst the people of the nation/society. Politics kills the patriotic fabric of the country by misuse of law and using loopholes of law to be in favor of the non-genuine people.

Politics and law if goes hand in hand can be very good for society as well. If politics is used without violating any law it becomes a legal way of revolution. For example Gandhi movement is one example of revolution which is very well accepted as legal form of protest. This way is political since the protest is done to get the law/rules amended.

To summarize, overall politics and law goes together in every society. Law is the legal form of rules/guidelines in a society which are enforced by authorities like police, courts etc and politics is the way of getting the law changed, may be in a right way by peaceful protest for the benefit of overall society or in a negative way for some personal gains.

Politics is essential in any country because there needs to be a common body who
can frame policies for the welfare of the people and these policies are then presented
in the parliament. A debate is held by the various political parties who can vote for
and against a particular policy. If there is a majority for a policy statement, it gets
passed as a law. If there is no majority, the bill gets rejected. Politics helps people
to understand the government and take a decision as to which party they would like to
bring to victory. The people have to understand and make a very important decision because this could make or mar their lives. They have to choose the government wisely.

Laws are made so that there is no confusion in the world. If there were no laws, people
would do what they considered right and indirectly it may affect someone else’s life.

They can commit grave crimes like murder too. This is one of the reasons why the founding fathers of the countries set up the Constitution. The constitution comprises of various laws. Each citizen of the country has to abide by these laws. In case, they break these laws, they will be punished as per the crime committed by them. Due to this people will fear to commit crimes.

Politics and law is interlinked in such a manner that one cannot survive without the other.
A law is a rule but people like to see faces that can represent this rule. Hence politicians
play a vital role as they represent the ideologies of their party. There can be many political
parties because opinions are many and each party will have their own ideas to run the
government. The people have to differentiate the views expressed by these parties and analyze and choose the right party to power so that the government can run smoothly. Sometimes there are independent candidates who stand on their own to express their views.

To start a political party you need to register with the state and country board of elections.
Next get some like minded people who agree with your ideas so that decisions can be taken easily within the party. A party leader is chosen to represent the party along with a symbol that can remind people in a simple manner the name of the party. All this is done in a legal manner. A delegate is a representative of the party sent on their behalf.

If you are interested in pursuing a career in public services and are interested in philosophy along with the political theory and elements of law, you can get a degree in public administration in a legal method. There are various colleges that fulfill the criteria and offer various courses to guide you to achieve your goals. The main philosophy behind politics and law is the smooth running of the government. There is no limitation to achieving your goals, so go ahead and choose your career wisely.

Some information on Politics and Law.

Politics means related to Government. Law is the rules and regulations required by everyone to be followed. The state affair s is run by representatives elected by voting. These representatives interact collectively and make decisions which are in favor of the state. Political law is a legal practice which covers both areas of politics and law. Laws for both the levels are included i.e state level and federal level.

The politicians during their election campaign need money. So, they send messages to big and small organizations for a donation. There are certain federal laws to follow for the limitations of finance i.e how much to accept in donation, how much to spend and where to spend. The representatives of the party should be well aware of these rules and accept donation according to laws. A report of income and expenditure should be submitted to the federal committee.

The money should be spent on canvassing, banners, stickers, building platforms for speeches, stationary used, etc. to promote the candidate to get more votes. The money should not be used for any personal luxuries. A donation of $2,300 is the limit for a political campaign according to federal laws. A businessman cannot donate finance from his business, but use finance from his personal account. A person who is from other country cannot donate, only a citizen can donate. Cash donation of 100$ only
is acceptable. The volunteers that work in the campaign do not get paid. They give their time voluntarily for serving the party. The soft drinks and tea and snacks, which are donated are also valued and noted in the report. The Federal Election Commission administers and enforces Federal Campaign Finance Laws.

The Federal Lobbying and Ethics Rules and Regulations sets the role of a lobbyist. Traditionally lobbying means that when the representatives gathered in the lobby after and before the debate. They sought their opponents and discussed with them and persuaded them to agree with a particular proposal.

A BBC news report shows that many decisions made in the House of Parliament are the results of direct lobbying. The lobbyist arranges a meeting to influence the member s vote. But there is a federal law where the lobbyist has to report annual disclosures. Gifts should not be accepted by a lobbyist otherwise it may be termed as a bribe. Attend event only at places where the Government sends him. He should not travel with any members. Penalties on the organizations are imposed in cash $200,000 and five year jail.

The representatives look after the administration of the state and the police department looks after the safety and peace inside the state. The Law Enforcement Code of Conduct should be respected by every police officer. He should treat every citizen equally whether he is rich or poor, of any religion or culture. He should help to protect the people s lives and property. During conflicts he should not hurt a citizen harshly but adopt methods to disintegrate the crowd. The citizen s duty is to co-operate with the officers.

The legal practice to follow political law is every citizens duty.

What Do You Know About Politic And Law

The difference between law and politics is like who has the right to make laws
and who has the right to enforce them. A public policy is expressed by the majority
of the people constituting a government. A law is more formal because it has to be
passed by a legislative body whereas a policy is informal and anybody can make policies.
But their policy needs a voice to win the debate among other politicians.

Politicians keep coming up with various policies as per the demand in the public whereas
a law is to be strictly adhered to when a policy is accepted. Politics is flexible and
this is one of the reason most of the lawyers begun to drift into politics. A law is the
result of policies set up by a government. The government has to look into various
departments like the educational, health, judiciary, environmental etc. Hence it requires
laws according to the limitations of that particular sphere.

Policies are the goals set up by the government and a law enforces these policies in their
proper format and looks into such details. A policy cannot be considered as a law until it
has been accepted by the judiciary and passed as a bill through the parliament after debating the pros and cons on the issue. There will be anti government politicians who may even try and stop passing that bill. So you cannot adjudge that all policies become laws.

It is legal for all the people to follow the laws set up in the country. They cannot cross
their limits as they will be bound by various laws in different fields. It is very essential
to have these laws because they will be the principal factors in guiding people in their way
of living. Those people who do not respect the laws will be punished according to the crime
committed by them. Laws help a government to set up a framework for the constitution of the country.

Hence it is for the new government to amend laws if necessary by submitting policy statement that can be approved or rejected based on the majority of votes in the parliament. This is legal and also mandatory. Generally, the executive who represents the government will recommend new policies on behalf of all its members. But this can be opposed by the opponent government and they have the right to stop the passing of this bill by creating a majority among their members.

Policies are made on behalf of the public keeping its welfare as the core requirement but
if the public feels it is not right, they can try to get that particular policy rejected or
taken back. The public can form small groups and oppose the bill in non-violent way like
fasting or blocking a road which is assessed by the present government to seek their attention. The government will then have no other alternative than to change it because they would not like to incur the wrath of the public.

The Legality of Politics and Politics of Legality

For the purposes of governing people, political legitimacy is of utmost importance. You can only govern those people who give you the power to stay through their votes. Politics has therefore become legal in the world, though indirectly. The procedure though which we choose our government in legal but there are so many smart players and so much loopholes that the legality is turned in their benefit and politics takes its own course, and the people remain under the impression that everything is fine. When we say legality of politics, this is exactly what we mean.

The politics in today’s world has become such an obvious thing that we don’t hesitate while talking about it in the public sphere because it is taken for granted that there will be politics, politicians and only they can run the government. Because we haven’t seen a government being run by methods apolitical, we have no clue whether it is even possible.

There was a time when India had only Congress as a political party. But now there is so many that more than choice, it has become confusion with each party trying its best to pull you towards them by promising and giving false hopes. Politics, however, is not confined to just public authorities or the government, but even in our day to day life in schools, colleges and corporate houses. People take to different means of getting popular and become the chosen one. The history of politics is reflected in the origin and development, and economics of the institutions of government.

Politics of legality is equally important area to think upon. Law is such a device which can be twisted and turned in anybody’s favour. Law, they say is a play of words. Though it is system of rules that guide our conduct and behavior towards our fellow human beings but then, who makes these laws? We ourselves. This means there is always the scope for little amendment here and there to suit the needs of the present generation. This is the politics of legality.

The legal framework which is supposed to be in place to help the deprived, has rather become an interesting tool in the hands of lawyers, who gain their living by making the law do something today and making it do something else the other day. The positioning of law with respect to the political realm is also quite interesting. This is when politics is identified as a set of complex values to be implemented by public authorities through the mechanism of law. when a particular political party governs the nation, it so happens that the existing law is amended to suit the thinking and ideology of that party. Gradually with various parties coming and going over the years, the law gets changed so many times that even people don’t know exactly what is the law.

Thus the legality of politics and politics of legality presents a view that the legal world is rather flexible towards the political one.

History and Law of Politics

Law and politics go hand in hand. They have been considered together while determination of various aspects of governance since time immemorial. Politics takes place at every stage of the Government and it is done through the laws made by the politicians themselves. So it is rather a vicious circle which goes on continuously. Law and ethics do form intersecting circles and therefore, ethics form a big part of politics as well. However, to what extent is it actually carried out? To what extent are our politicians ethical? Although ethics and law are compatible to a large extent as each one takes place when the other is missing but politics in today’s world is completely devoid of ethics.

Law is defined to be the set of rules which govern the behavior people. Politicians are supposed to aid in this governance. They form the backbone of the Government and people entrust them with the work of making laws as well as executing them. Thus it can be seen that law and politics are not separate from each other. Both of these works in the same field and by the same players, of course there are lawyers who make the best of a law available.

For the purposes of governing people, political legitimacy is of utmost importance. You can only govern those people who give you the power to stay through their votes. Politics and political discourse form a major part of the legal theoretical discussion. The need of the hour is to come up with laws which do not restrict politics but regulate it in order that it fulfills the purpose that is governance of the state, in a proper manner.
